Resigning from work and holiday whilst on maternity leave

Hi Everyone,

Really hoping somebody can help me!!

Am currently taking a year maternity leave and am due back at end of Feb 2011. Really don't want to go back and am thinking of giving my notice. Just wondering if I'll be entitled to any holiday pay owing to me that I've accrued whilst on maternity leave, or if I'll be better off taking my 4 weeks holiday immediately after maternity leave ends, and then hand in my notice on first day of holiday?

Does that make sense?

If anyone can offer advice it would be much appreciated,

you should be able to take the holiday youve accrued either as pay or time off. just one thing which you may have to do is pay back any maternity pay your company paid you, if you dont return for 3 months at the end of your ML.

think the pay back thing is only if your company offer extra incentives.
I looked into handing my notice in before i finished maternity leave and my employer would still have to keep paying me til end of the paid wks, even if i handed my notice in, but didnt affect what i got.
I ended up going back for a few months and took my hol on my return so got an extra few weeks off.
As it turns out, I got pregnant the day after I finished working there (!) and I am now able to claim stat mat pay for my second child even though im not working now (!), purely becuase of the maternity leave and the fact i went back to work as they counted it all as working.
